These Terms and Conditions of Service govern your use of any OBEDIA service and the OBEDIA Web site. By purchasing any OBEDIA service or using, visiting, or browsing the OBEDIA Web site, you accept and agree to be bound by these Terms and Conditions of Service. If you do not agree to these Terms and Conditions of Service, you should not purchase any OBEDIA service or use the OBEDIA Web site.

These Terms and Conditions of Service are an ongoing contract between you and OBEDIA and apply to your purchase of any OBEDIA service and use of the OBEDIA Web site. These Terms and Conditions of Service affect your rights and you should read them carefully.

Changes  to Terms and Conditions of Use

OBEDIA LLC reserves the right, from time to time, with or without notice to you, to change these Terms and Conditions of Use in our sole and absolute discretion. The most current version of these Terms and Conditions of Use can be reviewed by clicking on the "Terms and Conditions of Use " located at the bottom of the pages of the OBEDIA Web site. The most current version of the Terms and Conditions of Use will supersede all previous versions. Your purchase of OBEDIA Services or use of the OBEDIA Web site after changes are made means that you agree to be bound by such changes.

Registration

Definitions

Digital Audio Workstations

OBEDIA provides technical training and support to users of Digital Audio Workstations (DAWs). A DAW is defined as a system comprising a host computer, one or more MIDI or Audio Software applications, and various input and/or output peripherals, designed for the purpose of creating, recording, editing, mixing and producing Audio or Music.

Supported Products

Our list of supported computer operating systems, software applications and peripherals is constantly evolving as new products come on to the market. The current list of supported products can be found on the OBEDIA Website via the following link: supported products.We reserve the right not to provide services for any non supported product.

Technical Support Incident

When a customer calls for technical support a case is opened and a unique number is assigned to that case. Each case may comprise one or more problems, called incidents, that require a resolve. An incident is defined as a specific discrete problem with its own specific discrete resolution. OBEDIA in its sole discretion will determine what constitutes a Technical Support Incident.

 A resolution is reached when:

    1. OBEDIA provides information to the customer that resolves the problem
    2. OBEDIA provides information to the customer of known incompatibilities or bugs of software or other components within the DAW system.
    3. OBEDIA provides information to the customer that requires the customer to obtain an additional component that will resolve the problem
    4. OBEDIA provides information to the customer that a software upgrade is required.
    5. OBEDIA provides information to the customer that a hardware failure is the cause of the problem.

     

Expiration

Points expire 1 year from date of purchase. You will be notified via your message center as the expiration date approaches.

OBEDIA Services

Telephone Support

OBEDIA provides technical training and support twenty four hours a day seven days a week via telephone. This service is a paid service charged by the minute. Charges do not apply until the customer is talking with an OBEDIA technician. The customer has the option of paying per call at the time of the call or buying a prepaid package of minutes either through an official OBEDIA retailer or the OBEDIA website.

If the call is a technical support call it may consist of a number of incidents. OBEDIA will make its best efforts to bring a resolution to the incidents as defined in the Paragraph “Technical Support Incident”, but we are not liable for any events or circumstances beyond our reasonable control.

On Location

OBEDIA provides technicians for on site calls at a customer’s location within our service area. Our current service areas are posted on our website. For calls outside of OBEDIA’s service area additional trip charges apply. On site calls can be scheduled at any time. Standard business hours are 8am PST to 8pm PST. Additional charges may apply for rapid response services or services outside our standard business hours.

For on site calls the customer, or customers representative, must be at least 18 years of age and be present at all times during the visit. If the customer or customer’s representative is not present customer will be responsible for a minimum 1 hour cancellation fee and services will be denied. Reasonable access to the DAW system must be granted. The customer must back up all software and data that is stored on internal and external hard drives. OBEDIA and or it’s 3rd party service provider, shall not be responsible for the loss, alteration, or corruption of any software, data or files.

THE OBEDIA SERVICES AND WEB SITE AND ITS CONTENTS ARE PROVIDED "AS IS" AND WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE OBEDIA WEB SITE, ITS CONTENTS OR OUR SERVICE. WE DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, INCLUDING, FOR EXAMPLE, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN ADDITION, WE DO NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA OUR SITE IS ACCURATE, COMPLETE OR CURRENT.

UNDER NO CIRCUMSTANCES SHALL OBEDIA, IT’S OFFICERS, EMPLOYEES OR THIRD PARTY PROVIDERS BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, COSTS, LOSS OF EARNINGS, LOSS OR CORRUPTION OF DATA OR ANY OTHER LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED BY OBEDIA OR ITS THIRD PARTY PROVIDERS
